Mediation and Other ADR Services

If you have a major dispute in the context of an ongoing business relationship; if you are facing extensive, time-consuming discovery; or if you believe a party to your dispute simply has unrealistic expectations, then the judgment, expertise, and interpersonal skills of a neutral party may prove to be a valuable alternative to litigation.

Mediation and other alternative dispute resolution services can offer faster, less expensive, and more creative solutions in many situations.  Neutrals are trained to help develop options for resolving a dispute, and they can often assist in pointing out possibilities, changing perspectives, and otherwise altering the pre-existing dynamics so as to allow for a mutually acceptable result.  Mediation, in particular, can help the parties reach a solution without irreparable damage to ongoing relationships, the needless expenditure of time and money, or the pursuit of an uncertain judgment.

The firm offers mediation, arbitration, and neutral evaluation services in corporate and commercial matters through Larry Ashby, of counsel to the Corporate Litigation and Counseling group.  Larry combines formal mediation training and experience with decades of handling sophisticated corporate and commercial disputes and related litigation.  Larry has not only been called upon by his colleagues at the bar to serve as a mediator and arbitrator of business disputes, but by the Court of Chancery to serve as a receiver for a Delaware corporation with a deadlocked Board of Directors.

In ranking Larry as a leading practitioner in the Court of Chancery, Chambers USA: America’s Leading Lawyers for Business (2008) reported that Larry “uses his experience well in making suggestions and is also creative in finding solutions.”
